Please read these Terms of Service ("Terms") carefully before using turtelle.com or any tools, assessments, platform features, portals, or conversational interfaces provided by Turtelle Insurance Inc. ("Turtelle," "we," "us," or "our"). By accessing, browsing, or using our website, applications, or services, you agree to be legally bound by these Terms and our Privacy Policy. If you do not agree to all of these Terms, you are strictly prohibited from accessing or using our platform.
1. Acceptance of Terms & Eligibility
By accessing or using the Turtelle platform, you represent and warrant that you are a natural person of at least 18 years of age, possess the legal capacity to enter into a binding contractual agreement, and are a resident of the United States. If you are accessing or using the platform on behalf of a business entity, corporate partner, group sponsor, or employer, you represent and warrant that you possess explicit corporate and legal authority to bind that entity to these Terms. We reserve the absolute right to deny service, terminate accounts, revoke platform access, or restrict access to any user, segment, or entity who violates these Terms without prior notice or liability.
2. Description of Services & Multi-Sided Platform Architecture
Turtelle operates an online, multi-sided digital platform dedicated to life insurance education, data-driven lead-generation, insurance distribution assistance, independent agent marketplaces, and employer-sponsored group benefits matching. The platform components consist of: The Consumer Platform (incorporating the Family Protection Check(TM), Protection Score(TM), Protection Gap(TM), Employer Dependency Risk(TM), Protection Cliff(TM), Portable Shield(TM), Protection Report(TM), and Policy X-Ray(TM)); The Agent Platform (incorporating agent registration portals, lead management dashboards, consumer matching algorithms, and CRM pipeline software); The Employer Platform (incorporating employer registration dashboards, employee census data upload utilities, group insurance quote request engines, and voluntary benefits enrollment workflows); and Conversational Interfaces (incorporating automated AI chatbot systems providing general insurance lookups and live agent transfer protocols).
3. Educational Platform Disclaimer & No Fiduciary Relationship
Turtelle is a technology platform and digital distribution facilitator. TURTELLE IS NOT AN INSURANCE CARRIER, A LAW FIRM, A TAX ADVISOR, A FINANCIAL ADVISORY PRACTICE, OR AN INVESTMENT ADVISORY FIRM. No fiduciary, advisory, broker-client, agent-client, attorney-client, financial planner-client, or similar professional relationship is created, implied, or established through your use of the Turtelle platform, Family Protection Check(TM), Protection Score(TM), Protection Gap(TM), Employer Dependency Risk(TM), Protection Cliff(TM), Portable Shield(TM), Protection Report(TM), Policy X-Ray(TM), AI chatbot, or any educational content, articles, metrics, or vectors provided by Turtelle. All content, software operations, and algorithmic scores are intended strictly for general educational, illustrative, and informational purposes. Nothing on the platform constitutes formal financial planning, legal counseling, tax optimization, investment advice, or a personalized insurance recommendation.
4. No Insurance Advice, Underwriting, or Premium Guarantees
Turtelle does not provide specific insurance advice, nor do its proprietary scoring systems execute underwriting evaluations. Any scores, calculations, or financial gap assessments are automated, directional benchmarks. They do not constitute an insurance quote, a binder of coverage, an application for insurance, or a guarantee of insurability. Premium rates, medical classifications, underwriting parameters, policy approvals, and formal coverage binding are determined solely and exclusively by third-party insurance carriers following an independent, comprehensive review of medical histories, health examinations, lifestyle records, and full financial underwriting.
5. Geographic Licensing Disclosures & Limitations
Insurance products are offered through third-party licensed insurance professionals, agencies, independent marketing organizations, and corporate insurance carriers. Product availability, riders, exclusions, and rates vary heavily by state jurisdiction. Turtelle is a Delaware Corporation operating exclusively within the United States. Turtelle is not a licensed insurance agency in every state. In jurisdictions where Turtelle does not maintain required state insurance department entity licensing, platform content is strictly limited to general educational information regarding life insurance concepts and does not constitute a solicitation, advertisement, or offer to sell insurance or generate commercial referrals within those restricted states.
6. User Responsibilities for Accurate Information
By utilizing our intake tools, calculators, portals, census upload workflows, or conversational AI interfaces, you represent and warrant that all data, financial records, identifiers, age metrics, mortgage totals, benefit details, and household descriptions you provide are entirely accurate, current, true, and complete. If you submit information on behalf of another individual, employee, or corporate entity, you covenant that you possess explicit legal consent and authority to execute such data transfers. Understating, overstating, or falsifying information invalidates the algorithmic utility of the tools and constitutes a material breach of these Terms.
7A. Segment-Specific Provisions - For Consumers
Consumers utilizing the Family Protection Check(TM), Policy X-Ray(TM), or associated intake vectors acknowledge that all results are automated estimates based on limited self-reported inputs. By explicitly interacting with the platform to choose "Talk to a Local Agent," "Request Agent Assistance," or any equivalent call-to-action button, you authorize, instruct, and grant affirmative consent for Turtelle to securely transmit your contact information, Protection Score(TM), Protection Gap(TM), Employer Dependency Risk(TM), Protection Report(TM), and all associated assessment details to a qualified, third-party licensed insurance professional within our partner network to execute your request for follow-up consultation or quotes.
7B. Segment-Specific Provisions - For Insurance Agents
Insurance agents registering for platform access, lead management systems, or consumer matching systems represent, warrant, and covenant that they maintain active, valid, and unblemished insurance producer licenses and proper line-of-authority appointments in every state jurisdiction where they accept consumer leads or conduct business. Registered agents explicitly agree to comply with all applicable state insurance department regulations, fair marketing practices, the Telephone Consumer Protection Act (TCPA), CAN-SPAM, and state data privacy mandates when handling consumer lead data transmitted by Turtelle. Agents accept full responsibility for their outreach and sales conduct. Agents explicitly agree to indemnify, defend, and hold harmless Turtelle against any regulatory non-compliance, consumer complaints, civil actions, or statutory violations arising from their individual marketing, sales, follow-up activities, or use of transferred lead data.
7C. Segment-Specific Provisions - For Employers
Employers submitting corporate data, operational profiles, benefit parameters, or employee census data for corporate group life or supplemental health insurance quotes represent, warrant, and covenant that they have obtained all legally required explicit employee authorizations, disclosures, and consents mandated by applicable state and federal privacy regulations, employment statutes, and corporate privacy frameworks prior to uploading or transmitting such sensitive census information to Turtelle. Employers indemnify Turtelle against any data privacy breaches or employee claims resulting from the unauthorized transmission of organizational census records.
8. Intellectual Property, Trademarks, & Proprietary Protections
The Turtelle website, its specialized user interface layouts, software code, source models, custom algorithms, calculation logic, text graphics, design frameworks, and interactive chatbot structures are the exclusive property of Turtelle and are protected by United States copyright, trademark, and trade secret laws. Specifically, Turtelle(TM), Family Protection Check(TM), Protection Score(TM), Protection Gap(TM), Employer Dependency Risk(TM), Protection Cliff(TM), Portable Shield(TM), Protection Report(TM), and Policy X-Ray(TM) are proprietary trademarks owned exclusively by Turtelle Insurance Inc. You are granted a limited, non-exclusive, non-transferable, revocable license to access the platform and download your generated Protection Report(TM) strictly for personal, non-commercial use.
9. Anti-Scraping & Reverse-Engineering Prohibitions
You agree that you will not use, or allow any third party to use, any automated bots, web scrapers, spiders, crawler scripts, data extraction software, or parallel processing tools to harvest, mine, scrape, or extract proprietary calculation variables, code blocks, algorithmic metrics, consumer fields, or platform data from turtelle.com. Furthermore, you are strictly prohibited from reverse-engineering, decompiling, disassembling, deconstructing, or attempting to derive the source code or underlying mathematical logic of the Protection Score(TM) engine, Policy X-Ray(TM) processing systems, or chatbot matrices.
10. Referral Compensation Disclosure
Turtelle operates commercially as a lead-generation platform, marketing vehicle, and digital distribution assistant. You are hereby notified and explicitly acknowledge that Turtelle may receive referral fees, lead fees, direct commissions, marketing allowances, or other financial compensation from independent insurance agents, agencies, insurance brokers, independent marketing organizations (IMOs), and insurance carriers in exchange for consumer data matching, software usage, or advertising placement. The receipt of such financial compensation by Turtelle does not guarantee, imply, or suggest that any particular carrier product, insurance policy, or financial solution discussed or presented on the platform is suitable, optimal, or appropriate for your individual risk portfolio or household situation.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TURTELLE INSURANCE INC., ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, DATA PROVIDERS, AGENT PARTNERS, OR LICENSED INDEPENDENT MARKETING ORGANIZATIONS (INCLUDING BACKNINE) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA LOSS, USE SEIZURE, LOSS OF GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH: (I) YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE PLATFORM; (II) ANY CONVERSATIONAL ASSISTANCE OR EDUCATIONAL TEXT GENERATED BY THE AI CHATBOT SYSTEM; (III) THE ACCURACY, RELIABILITY, OR OUTPUT VALUE OF THE PROTECTION SCORE(TM) OR ASSOCIATED ESTIMATES; (IV) THE ACTIONS, OUTREACH, ADVICE, OR REPRESENTATIONS OF ANY INDEPENDENT LICENSED AGENT PARTNER TO WHOM YOU WERE REFERRED OR MATCHED; OR (V) ANY UNAUTHORIZED ACCESS OR SEIZURE OF YOUR DATA BY THIRD-PARTY MALICIOUS ACTORS. TURTELLE'S TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS, DISPUTES, OR BREACHES ARISING UNDER THESE TERMS SHALL NOT EXCEED ONE HUNDRED US DOLLARS ($100.00). [NOTE: This liability cap should be reviewed by a licensed attorney before final publication.]
12. Indemnification
You agree to defend, indemnify, and hold harmless Turtelle Insurance Inc., its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, and licensed distribution partners from and against any and all third-party claims, damages, statutory penalties, losses, liabilities, settlement obligations, costs, or debts, and expenses (including but not limited to reasonable attorney's fees) arising directly or indirectly from: (i) your access to and utilization of the Turtelle platform; (ii) your violation of any provision of these Terms or our Privacy Policy; (iii) your violation of any third-party right, including without limitation any intellectual property right or privacy right; (iv) any claim that data or employee census inputs submitted by you caused damage or data exposure to a third party; or (v) your violation of any applicable local, state, or federal laws, statutes, or administrative regulations.
13. Mandatory AAA Arbitration & Governing Law
These Terms and any disputes arising out of or relating to your utilization of the platform shall be governed by, construed, and enforced in accordance with the internal substantive laws of the State of Delaware, without regard to its conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms, or the breach, enforcement, interpretation, or validity thereof, shall be settled exclusively by binding individual arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The place of arbitration shall be Wilmington, Delaware, and the proceedings shall be conducted in the English language.
14. Class Action Waiver
YOU AND TURTELLE EXPLICITLY AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS, WHETHER IN ARBITRATION OR COURT, WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, REPRESENTATIVE, OR COLLECTIVE ACTION. You explicitly waive your right to participate as a class representative or class member in any class-wide arbitration, class action suit, or private attorney general proceeding against Turtelle Insurance Inc.
15. Termination
We reserve the right, in our sole and absolute discretion, to terminate, suspend, or restrict your access to the Turtelle platform immediately, without prior notice, administrative delay, or liability, for any reason whatsoever, including without limitation your material breach of these Terms. Upon termination, your legal license to utilize the platform interfaces immediately ceases.
16. Severability & Entire Agreement
If any provision or clause of these Terms is determined to be unenforceable, illegal, or invalid by an arbitrator or a court of competent jurisdiction, that specific provision shall be limited, modified, or eliminated to the minimum extent necessary so that the remaining provisions of these Terms shall otherwise remain in full force, legal effect, and operability. These Terms, combined with our Privacy Policy, Licensing Disclosures, and Protection Score(TM) Disclaimers, constitute the entire legal agreement between you and Turtelle Insurance Inc. regarding platform utilization.
17. Changes to Terms
Turtelle reserves the right to modify, amend, rewrite, or replace these Terms at any time. We will post notice of updates by changing the "Last Updated" date at the top of this document. Your continued use of or access to the website, portal, or chatbot following the posting of any adjustments constitutes your binding and formal acceptance of the updated Terms.
